無(wú)害通過(guò)制度的發(fā)展及其現(xiàn)狀研究

摘  要

無(wú)害通過(guò)權(quán)問(wèn)題1直是世界各國(guó)關(guān)注的焦點(diǎn)之1，它是傳統(tǒng)海洋法賦予外國(guó)船舶無(wú)害通過(guò)1國(guó)領(lǐng)海的1項(xiàng)重要權(quán)利，是對(duì)國(guó)家領(lǐng)土主權(quán)的限制，也是目前海洋法的重要內(nèi)容之1。本文主要通過(guò)研究無(wú)害通過(guò)制度的歷史發(fā)展過(guò)程，論述了現(xiàn)階段無(wú)害通過(guò)權(quán)與國(guó)家領(lǐng)土主權(quán)的沖突問(wèn)題和解決方案以及無(wú)害通過(guò)對(duì)國(guó)際人道主義的意義。

ABSTRACT

The problem of the right of Innocent Passage was one of the world focus, which is the Traditional Law of the Sea gives foreign vessels of innocent passage through the territorial waters of a country an important right, the country’s sovereignty and territorial restrictions, the law of the sea is currently one of the important contents. This essay mainly studies the historical development process of Innocent Passage Policy, and discussed at this stage Innocent Passage Policy and the conflict and solutions of national sovereignty. And Innocent Passage passed the significance of international humanitarian.
