論我國(guó)的起訴便宜主義
摘 要
起訴便宜主義是順應(yīng)各種刑事政策權(quán)衡和增強(qiáng)訴訟效率的要求，具有合理性基礎(chǔ)的不起訴制度的原則之1。起訴便宜主義在當(dāng)今世界各國(guó)刑事訴訟中都有著直接的體現(xiàn)和廣泛的運(yùn)用，并出現(xiàn)了新的發(fā)展趨勢(shì)。我國(guó)應(yīng)在借鑒起訴便宜主義合理內(nèi)核的基礎(chǔ)上，重塑公訴裁量權(quán)，完善酌定不起訴制度。

ABSTRACT
Doctrine of sue prosecution complies with every kinds of criminal policy balance and it is a demand that strengthen the effect of lawsuit, it is one of legal pinciples in non-prosecution system. Nowadays, in every kinds of criminal lawsuits in the world, doctrine of sue prosecution is reflected directly and used wildly, meanwhile, there came out a new developping trend. Our country should base on the legal core of doctrine of sue prosecution, rebuild the ruling power of public prosecution and consider the system of public prosecution perfectly.
